Letter from Bainbridge Christy I to his brother Phillip W. Christy

Dear Brother the only esccus I have to offer for neglecting to write in answer to your letter is this I recieved yours and one from Father not long between and I wrote to you in the letter to Father and I have been looking for a letter from some of the family ever since without the pleasure of recieving one line. Tharefare I have concluded to write again in hope that some of you will write in answer. Thanks be to our Heavenly Father that he is yet mindful of us and merciful unto us for he continues to pass out his blessings of health peace and plenty upon us. I have but little news to write. The most interesting is another boy has apeared in our family. He is now one month old and is large and lively. I expect we will call his name Porter L .
James and Samuel Armstrong called to see me in their travels through this state and stayed three days with us. I was truly glad to see them. James told me all the particulars about all the relations which was a great satisfaction but O the sad news of the death of our dear Brother was heartrending to me for I loved him dearly. But thanks be to God for the Christians consolation in the time of such berievements. Oh my brother this is another evidence that we are a diing family. Tharfare my dear brother let us the remaining fractions live for that when we all shall be called into eternity. We may be reunited in one happy family in the Heavens of eternal blys is my prayer. We went to see Joann and Francisco in August and found them and theirs all well and also well pleased with the country they sied they intended to write Father in a few days. Joann has a daughtter she calls it Elizabeth.
If you are willing to pay 40 dollars for that note and will pay it by the first of April you may have it as I shall then have an oppertunity of having it brought to me by one of my neighbours who will be thare at that time. Shew this to John L. Ramsey and he will let you have the note for the above. I some times think of coming to see you all next summer but that is very uncertain unles I can get some trusty person to take charges of my affairs. Write without fail. Give love to all the friends.
Tell Father I want to see him again in this life if the Lord is willing. Tell him not to let his bodily afflictions his confidence in his redeamer. They may be intended for blessing at last. Tell him to write to me soon. I wish to hear from Elizabeth Harrson and Elizabeth Northcutt and Ambrose. Give my love to mother. Nothing more.

State of Kentucky Fleming County Jct
Before me Dixon Clack one of the commonweatlhs Justices of the peace for said county personally appeared Joseph K. Christy and made oath in due form of law that he was present when a contract or testement took place between Bainbridge Christy, and Philip W. Christy in Sept 1843 in relation to a note given by the said Philip to the said Bainbridge
Christy in July 1836 for the sum of 65 dollars which note had a credit of 27 dollars on it and that he the said Bainbridge did agree to take 35 dollars for said note from him the said Philip W. Christy.
Given under my hand as a Justice of the peace this 15th day of August

I William Whitsett applicant for Letters of administration on the estate of Bainbridge Christy deceased do make
oath and state to the best of my knowledge and belief that the names of the heirs of said deceased are as follows
to wit Dulcena Christy widow and Joseph Christy and Porter Christy children of said deceased and that they all reside in Lafayette County Missouri that the said deceased died without a will and that I will make a perfect inventory of and faithfully administer all the estate of the said deceased and pay the debts as far as the assets will extend and the law direct and account for and pay and deliver all the money and property all assets which shall come to my possession or knowledge

M Coy as securities all of the County of Lafayette and State of Missouri, are held and firmly bound unto the State of Missouri, in the sum of two thousand dollars for the use and benefit of Joseph Christy, Porter Christy and Bainbridge Christy minor heirs of Bainbridge Christy deceased For the payment of which will and truly to be made, we bind ourselves our heirs, Executors and administrators jointly and severally firmly by these presents sealed with our seals and dated this 7th day of January AD 1851.
The condition of the above obligation is that whereas William Whitsitt the above bound has this day been appointed, Curator of the estate, and Guardian of the persons of the above named minor heirs of Bainbridge Christy deceased by the judge of the Probate Court of Lafayette County – Now if the said William Whitsitt shall faithfully discharge the duties of Curator and Guardian of said minor heirs required by law then the above bond to be void otherwise to remain in full force

To the Honorable the Justices of the County Court of Lafayette County in the State of Missouri Your petitioner Burgess Delay of the County aforesaid would respectfully state that on or about the 22nd day of February in the year 1844 one
Bainbridge Christy late of the same County entered into a written contract binding himself and his heirs Executors or administrators for the Consideration of Two hundred and sixteen Dollars and interest thereon until paid ten percent to convey to one Henry Coursey the following described tract of land situate in said County of Lafayette to wit.
The East half of the South East quarter of Section Thirty The South East quarter of the North East quarter of Section Thirty one in Township forty eight Range Twenty Seven supposed to contain one hundred and Twenty acres with the exception of one out of said lands and a half acres reserved which is bound as follows exception of 1 acres is bounded as follows to wit to corner on the West line of said tract of land and which said 1½ acres is bounded as follows commencing at a rock and oak tree and running thence east Two chains and 71 links to a rock Thence North five chains and fifty three links to a rock. Thence West Two chains and 71 links to a rock thence South five chains and 53 links to a rock the place of beginning. That the said Bainbridge Christy afterwards some time of the year died without having ever conveyed said land and without having given power by will to convey the same.
Your petitioner would further state that after the death of said Christy the said Henry Coursey for a valuable consideration namely for the consideration of five hundred and sixteen dollars sold and assigned the said written contract to your petitioner and by a written endorsement upon said written contract duly assigned the said written contract to your petitioner and thereby authorized and directed the deed for the land therein mentioned to be made and delivered to your petitioner.
Your petitioner would further state the consideration agreed to be paid to said Christy for said land has been fully paid. Wherefore your petitioner prays that William Whitsitt the administrator of said Christy estate may be required by an order of this court to execute specifically such written contract by making to your petitioner as the assigned of said written contract a deed for the said land therein described, and your petitioner here with files the said written contract with the said assignment thereon endorsed which he prays may be considered as a part of his petition

Burgess Delay makes oath and states that that the facts matters and things set forth and contained in the foregoing petition are true and that no part of the written contract therein recited and hereto attached has been satisfied except as stated in the in said petition

The undersigned Administrator of the Estate of Bainbridge Christy dec’d would respectfully report to the court that since he made his final settlement of the said Estate of he has collected of Phillip Christie the sum of Thirty five dollars on the note due by him to said estate That he has recd since his final settlement the sum of $60.00 for the hire of Negro Boy Roland for the year 1848 and for the hire of the Girl Caroline for the year 1948 he has recd the sum of Twenty five Dollars. And that he has also rec’d for the year 1948 the sum of fifty dollars, which is subject to distribution after paying there from the expenses of taking care & supporting the minor children of said dec’d for the year 1848
